By using Exerlist, you consent to the data practices described in this Policy.

• Billing information (processed by Stripe; we do not store full card details) 

2.2 Content You Upload 

• Product photographs you submit for AI analysis 

• Optional product descriptions you provide 

• Generated listing content and edits 

2.3 Usage Data 

• Log data (IP address, browser type, pages visited, timestamps) 

• Feature usage events and interactions (collected via PostHog) 

• AI API usage and credit consumption (monitored via Portkey)

• Browser type and version 

• Operating system

3. How We Use Your Information 

We use collected information to: 

• Provide, operate, and improve the Service 

• Process AI image analysis via OpenAI APIs 

• Manage subscriptions and process payments via Stripe 

• Authenticate users via Supabase and Google Auth 

• Analyze feature usage and improve user experience via PostHog 

• Monitor AI API performance and costs via Portkey 

• Train and improve our AI models using uploaded product images (see Section 4) 

• Send transactional emails and service notifications

4. AI Model Training 

By uploading product photographs to the Service, you grant us a license to use those images to train, fine-tune, and improve our AI models and related features. We may share de-identified image data with AI model providers for this purpose. 

If you do not wish your images to be used for model training, you may contact us at support@exerlist.com to request exclusion. Opt-out requests will be honored prospectively and cannot be applied retroactively to images already used in training. 

5. Third-Party Service Providers 

We share data with the following third parties as necessary to operate the Service: 

• OpenAI — AI image analysis and content generation (product images and prompts sent to OpenAI APIs) 

• Stripe — Payment processing (billing data) 

• Supabase — Authentication, user data storage, and database hosting 

• Google (OAuth) — Authentication via Google Sign-In 

• Vercel — Application hosting and edge delivery 

• PostHog — Product analytics and usage tracking 

• Portkey — AI gateway, request routing, and API monitoring 

Each provider has its own privacy policy. We contractually require providers to handle data in accordance with applicable law. 

6. Data Retention 

We retain account information for as long as your account is active. Uploaded product images are retained to provide the Service and for model training purposes. Generated content is stored in your account until you delete it or close your account. 

Upon account deletion, personal information is deleted or anonymized within 30 days, except where retention is required by law. 

7. Data Security 

We implement industry-standard security measures including encryption in transit (TLS), access controls, and secure database practices via Supabase. However, no system is completely secure, and we cannot guarantee absolute security of your data.

8. Your Rights 

Depending on your jurisdiction, you may have the right to: 

• Access the personal information we hold about you 

• Request correction of inaccurate data 

• Request deletion of your personal data 

• Opt out of AI model training use of your images 

• Data portability (receive your data in a structured format)

9. California Residents (CCPA) 

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information is collected, the right to delete personal information, the right to opt-out of the sale of personal information (we do not sell personal information), and the right to non-discrimination.

10. International Users 

The Service is operated in the United States. If you access the Service from outside the US, your information may be transferred to and processed in the US. By using the Service, you consent to such transfer. We take steps to ensure adequate protection for international data transfers. 

11. Children's Privacy 

The Service is not directed to individuals under 18 years of age. We do not knowingly collect personal information from minors. If we become aware that we have collected information from a minor, we will delete it promptly. 

12. Changes to This Policy 

We may update this Privacy Policy from time to time. We will notify users of material changes via email or a prominent notice on the Service. Continued use after updates constitutes acceptance.
