a) Refund Policy

1. Refund Policy 

All subscription fees and credit purchases are generally non-refundable. By subscribing to any Exerlist plan or purchasing credits, you acknowledge that:

* Payments are final under normal circumstances

* Unused credits, partially used subscription periods, and dissatisfaction with content quality are not automatic grounds for a refund

That said, Exerlist may issue a full or partial refund, or credit your account, at its sole discretion — for example in cases of technical issues, low content quality, or other situations reviewed on a case-by-case basis. Refunds are not guaranteed and are handled individually by our support team. To request a refund, contact support@exerlist.com with your account email and a description of the issue.

2. Subscription Cancellation 

You may cancel your subscription at any time through your account settings. Upon cancellation:

* Your subscription remains active until the end of the current billing cycle

* No further charges will be made

* Unused subscription credits expire at the end of the billing cycle

* Access to the Service terminates at the end of the paid period

3. Duplicate or Unauthorized Charges 

If you are charged twice for the same billing period due to a technical error, or if a charge was made without your authorization, contact us immediately. Report such issues to support@exerlist.com within 7 days of the charge date. We will review and respond within 5 business days.

4. Chargebacks 

Initiating a chargeback through your bank or credit card provider without first contacting us may result in immediate suspension of your account pending investigation. We reserve the right to dispute chargebacks that we believe are unauthorized or fraudulent. 

5. Price Changes 

We reserve the right to change subscription pricing with 30 days' advance notice. Price changes do not entitle existing subscribers to refunds for previously paid periods.

b) Acceptable Use Policy

1. Purpose 

This Acceptable Use Policy ("AUP") governs your use of the Exerlist platform and supplements our Terms of Service. By using the Service, you agree to comply with this AUP. 

2. Permitted Uses 

The Service may be used to: 

• Generate product listings and SEO content for lawful e-commerce purposes 

• Publish generated content directly to your own connected Shopify store

• Upload product images you own or have rights to use 

• Export generated content for use on e-commerce platforms (Shopify, Amazon, eBay, WooCommerce, etc.) 

• Edit and customize AI-generated content for your business 

3. Prohibited Content 

You may not upload or use the Service to generate content related to:

• Illegal products or services (counterfeit goods, controlled substances, weapons, etc.) 

• Adult content or sexually explicit material 

• Products that infringe third-party intellectual property rights 

• Fraudulent, misleading, or deceptive product listings 

• Products regulated without proper licensing (pharmaceuticals, financial instruments, etc.) 

4. Prohibited Conduct 

You may not:

• Attempt to reverse-engineer, decompile, or extract source code from the Service 

• Connect a Shopify store you do not own or are not authorized to manage

• Use automated scripts, bots, or crawlers to access the Service beyond normal use 

• Share your account credentials or allow unauthorized third-party access 

• Resell or sublicense access to the Service 

• Attempt to circumvent credit limits, billing systems, or subscription restrictions 

• Engage in any activity that could harm, disrupt, or impair Service infrastructure 

• Upload malware, malicious code, or harmful files 

5. Image Upload Requirements 

All images uploaded to the Service must: 

• Be product photographs you own or have rights to upload 

• Not contain personally identifiable information of individuals without consent 

• Not contain illegal content 

Uploaded images may be used to improve our AI models as described in the Privacy Policy. 

6. AI-Generated Content Responsibility 

You are solely responsible for reviewing, editing, and verifying all AI-generated content before publication. The Company does not guarantee the accuracy, uniqueness, or legal compliance of generated content. You must ensure generated listings comply with platform policies (Shopify, Amazon, etc.) and applicable laws. 

7. Enforcement 

Violation of this AUP may result in: 

• Warning or content removal 

• Temporary or permanent account suspension 

• Termination without refund

d) AI Content Disclaimer

1. Nature of AI-Generated Content 

Exerlist uses OpenAI's artificial intelligence models to analyze product photographs and generate product listings, SEO content, marketing copy, and product images. Image generation requests are routed through Fal AI, a third-party infrastructure provider. AI-generated content is produced algorithmically and may contain errors, inaccuracies, or omissions. 

2. No Guarantee of Accuracy 

We do not guarantee that AI-generated content will be: 

• Factually accurate or error-free 

• Suitable for any specific platform, marketplace, or regulatory context 

• Unique or free from similarity to content generated for other users 

• Protected by copyright or intellectual property law 

• Compliant with platform-specific policies (Amazon, Shopify, eBay, etc.) 

3. User Responsibility 

You are solely responsible for:

• Reviewing all generated content before publication 

• Ensuring content accuracy and legal compliance 

• Verifying compliance with third-party platform terms 

• Obtaining any necessary legal review for regulated product categories 

4. Third-Party Platform Compliance 

Use of the Service does not guarantee that generated content will comply with Shopify, Amazon, eBay, or other marketplace policies. Users must independently verify compliance before publishing. 

5. Intellectual Property Notice 

AI-generated text may not be fully protected by copyright under current U.S. law. The Company makes no representations regarding the copyright status of generated content. Users assume all risk associated with using generated content.
